This agreement is made between Rebecca McCarthy School of Dance, located at 8505 Redtail Unit D, Lakewood, IL 60014 ("School"), and the signing adult or guardian ("Adult"), on behalf of themselves and any minor child/children specified on this form (collectively, "Participants").
1. Waiver and Release of Liability
Participants, on behalf of themselves and their families, heirs, and representatives, forever and unconditionally waive, release, and discharge RMSD and its employees, owners, members, directors, affiliates, and representatives from any and all claims, damages, or losses — known or unknown — arising out of or related to Participants' use of the School's equipment and facilities, and participation in the School's activities, including any related costs, expenses, or attorneys' fees.
2. Assumption of Risk
Participation in RMSD activities and use of studio equipment is voluntary and involves inherent risk of serious injury or property damage. While safety equipment and instructor guidance (such as spotting or assisting) are provided to reduce risk, not all risks can be eliminated. Participants assume the risk of personal injury, death, or property damage arising from their use of the facilities and participation in RMSD activities.
3. Policies & Procedures
Families acknowledge receipt of RMSD's current policies and procedures, which may be updated at any time. RMSD will share any updates within a reasonable time after they take effect. Compliance with these policies is required for enrollment, participation in activities, and use of the studio's equipment and facilities.
4. Photograph Release
RMSD is granted the right to take and use photographs of Participants — with or without name — for lawful purposes connected to RMSD, including publicity, illustration, advertising, and website content.
5. Integration & Severability
This agreement stands on its own, without reliance on outside representations. If any part of it is found invalid, the rest remains fully enforceable.
6. Binding Nature of Agreement
This agreement is binding on all parties and extends to their successors and assigns.
7. COVID-19 Waiver of Liability
COVID-19 is a highly contagious, pandemic-designated illness. RMSD has implemented preventative measures (sanitizing stations, an open lobby area, and air purification) but cannot guarantee against exposure or infection. By accepting, families acknowledge this risk and release RMSD, its employees, and representatives from claims related to COVID-19 exposure or infection occurring before, during, or after participation in RMSD programs — including claims based on RMSD's actions, omissions, or negligence.
8. Choice of Law / Jurisdiction
This agreement is governed by and construed under the laws of the State of Illinois.
9. Agreement
By accepting below, the Adult confirms they have read and understood every provision above, voluntarily accept its terms, and certify they are the parent or legal guardian responsible for any minor child(ren) named on this form, and wish for the Participant(s) to take part in RMSD's activities and use its equipment.
